PRIVACY POLICY

The National Business Center (NBC) collects and processes personal data in accordance with Law No. 9723, dated: 03.05.2007, “On Business Registration”, as amended (hereinafter referred to as the Law “On Business Registration”), Law No. 10081, dated 23.2.2009 “On Licenses, Authorizations and Permits in the Republic of Albania”, Law No. 112/2020 “On the Register of Beneficial Owners”.

This privacy policy document shows how the NBC stores personal data collected in relation to:

1. Individuals to whom the data that are registered, licensed and licensed (which are notified or deposited in the registers) belong, or other persons who, according to the laws, have the right to request the performance of actions in the register.

2. Complainants who file administrative complaints against the actions or inactions of the QKB regarding registrations and publications.

In accordance with the Law “On Business Registration”, the Law “On Licenses, Authorizations and Permits in the Republic of Albania” and Law No. 112/2020 “On the Register of Beneficial Owners”, the data declared by applicants, for registrations and publications in the commercial register, are collected and stored in the electronic commercial register and archived physical files. Based on this law, the data that are registered and published in the register are freely accessible with the exception of data to which third parties have limited access.

The CNB assures each applicant that the data that reaches the database is provided through a secure system and used only for the purpose of maintaining the commercial register according to Law No. 9723, dated 03.05.2007, “On Business Registration”, as amended, Law No. 10081, dated 23.2.2009 “On Licenses, Authorizations and Permits in the Republic of Albania” and Law No. 112/2020 “On the Register of Beneficial Owners”.

The CNB is committed to implementing the legal framework in force for the protection of personal data.

“Obtaining consent” and informing about the publication of data is done at the moment of application.

The CNB is legally obliged to inform and make available personal data to judicial bodies of criminal prosecution, etc. state bodies (eg: Court, Prosecutor’s Office, etc.), when requested by them in accordance with the legal provisions in force.

Complainants against actions or omissions of the National Business Center (NBC)

To file a complaint regarding the actions or omissions of the National Business Center (NBC), you can use the complaint form on the website, where you will receive a response via email, or through a letter, where the complaint is recorded in a special register by the archive employee. The personal data collected during this process are used only for the review of the complaint and will be stored in a secure environment, with limited access to ensure the confidentiality and security of the information.

For each NBC employee, we prepare the relevant file. The data contained in it are kept secure and are used only for purposes directly related to the person’s employment. When the employment relationship with the QKB ends, the QKB stores the file in accordance with the law on the status of civil servants, the law on archives and the internal regulations of the institution.

Visitors to our website and the electronic system

The National Business Center has the official website www.qkb.gov.al. Through this website, the QKB comes to the aid of commercial entities and not only, by presenting the legal framework that applies to the process of commercial registration and the register of permits/licenses and authorizations, as well as by providing other useful information. For visitors to www.qkb.gov.al, the system collects standard information for statistical purposes, (Example: To see what the number of visitors is, always without making them identifiable).

The QKB uses modern technology to protect the security and confidentiality of data of entities/applicants, as well as to prevent access to the electronic system by unauthorized persons. The infrastructure on which the QKB system is built is part of the government network GovNet. Our security procedures are constantly improved with new technologies. The environment where servers and other equipment are stored is monitored by cameras and can only be accessed by the staff of the Directorate of Innovation and Registries.
